{"id":1129,"date":"2010-03-22T10:29:56","date_gmt":"2010-03-22T14:29:56","guid":{"rendered":"http:\/\/lucas-photo.com\/blog\/?p=1129"},"modified":"2010-03-22T11:04:54","modified_gmt":"2010-03-22T15:04:54","slug":"health-scare","status":"publish","type":"post","link":"https:\/\/lucas-photo.com\/blog\/2010\/03\/22\/health-scare\/","title":{"rendered":"Health scare"},"content":{"rendered":"<p>The great legal challenge to the health care bill is both procedural and Constitutional.<\/p>\n<p>Pursuant to the <a href=\"http:\/\/caselaw.lp.findlaw.com\/data\/Constitution\/amendment10\/\" target=\"_blank\">10th Amendment<\/a>, Congress does not have the authority to just vote themselves new powers such as it is attempting to do.  <\/p>\n<p>What would be needed for such a thing to happen would be a national referendum with a majority of Americans voting to modify the Constitution to say that health care is a right (which it isn&#8217;t, not least because there is no <a href=\"http:\/\/lucas-photo.com\/blog\/?p=180\" target=\"_blank\">equal and opposite responsibility<\/a> that can be associated with it) and that we wish to cede to the Federal government the authority to administer it.<\/p>\n<p>Moreover, also pursuant to the 10th Amendment, the Federal government <a href=\"http:\/\/www.reuters.com\/article\/idUSN2219276420100322\" target=\"_blank\">lacks the authority to compel citizens to purchase a given product or service<\/a>.
